Welcome to AndroidWinTool, operated by Isikman Limited ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website (androidwintool.com), user portal, support services, and any related online features or services (collectively, the "Services"). By accessing or using the Services, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Definitions

• a. "Services": means the AndroidWinTool website, software, user portal, support systems, and any related online features or services provided by the Company.
• b. "Account": means the username and password you select to access the Services.
• c. "Content": means information, text, graphics, or other materials provided by the Company or Users through the Services.
• d. "Software": means the AndroidWinTool software product, governed by the End User License Agreement (EULA) at androidwintool.com/eula.

2. Scope of Services

• a. Description: The Services provide access to tools, support, and resources for Android device management, including account management, payment processing, and technical support. Use of the Software is governed by the EULA.
• b. Eligibility: You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you must provide verifiable parental consent. You represent that you have the authority to enter these Terms.
• c. Access: We may modify, suspend, or discontinue any part of the Services at any time without notice. Access may be temporarily unavailable due to maintenance or other causes beyond our control.

3. User Account

• a. Registration: You may need to create an Account to access certain Services. You are responsible for maintaining the confidentiality of your Account and all activities conducted through it.
• b. Security: Notify us immediately at [email protected] if you suspect unauthorized access to your Account. You agree to keep your Account information accurate and current.
• c. Monitoring: We may monitor Accounts to ensure proper operation, compliance, and security of the Services.

4. User Conduct

You may not use the Services to:

• a. Engage in illegal, harmful, or offensive activities, such as harassment, defamation, or invasion of privacy.
• b. Impersonate others or misrepresent affiliations.
• c. Transmit spam, viruses, or malicious code.
• d. Use automated systems (e.g., bots, spiders) to access the Services excessively.
• e. Violate any applicable laws or third-party rights.

We may suspend or terminate your access for violations of these standards.

5. Content

• a. Company Content: All Content provided by us is protected by intellectual property laws. Your use is governed by these Terms.
• b. User Content: You are responsible for any Content you post. By posting Content, you grant us a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, and display such Content. You warrant that you have all necessary rights to post Content.
• c. Content Accuracy: We do not verify the accuracy of User Content and are not liable for its completeness or suitability.

6. Payments and Refunds

• a. Fees: Some Services or Software features require payment. All fees are non-refundable unless stated otherwise.
• b. Refund Eligibility: Refunds for unused Services or Software licenses may be considered if: (i) the purchase was made within 24 hours; (ii) the Service or license is unused and unbound; and (iii) a written request is submitted to [email protected] within that period. We will respond within 7 business days. Refund decisions are at our discretion.
• c. Abuse Prevention: Attempts to bypass payment systems, exploit refunds, or initiate unauthorized chargebacks may result in account termination and legal action.

7. Privacy

Your data is collected, stored, and used in accordance with our Privacy Policy, incorporated herein by reference. You are responsible for ensuring your use of the Services complies with applicable laws in your jurisdiction.

8. Intellectual Property

• a. Ownership: The Services and all related intellectual property are owned by the Company and its licensors. Your access is licensed, not sold.
• b. Restrictions: You may not copy, modify, distribute, or create derivative works of the Services or our intellectual property without our written consent.
• c. Copyright Complaints: To report copyright infringement, contact our copyright agent at [email protected] with the following: (i) identification of the copyrighted work; (ii) identification of the allegedly infringing material; (iii) your contact information; (iv) a statement of good faith belief that the use is unauthorized; (v) a statement that the information is accurate, under penalty of perjury; and (vi) your signature or electronic equivalent.

The Services may contain links to third-party websites or resources. We do not endorse or control such sites and are not liable for any damages or losses resulting from your use of them.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free access. Some jurisdictions may not allow certain warranty exclusions.

11. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, consequential, or punitive damages arising from these Terms or the Services. Our total liability for direct damages shall not exceed the fees you paid. You assume all risks for use of the Services.

12. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, and their officers, employees, and agents from any claims, damages, or costs (including attorney’s fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

13. Dispute Resolution

All disputes arising under these Terms shall be resolved exclusively in the courts of Hong Kong under Hong Kong SAR law, excluding conflict of laws principles. You agree to submit to the jurisdiction of Hong Kong courts.

14. Termination

• a. By User: You may terminate these Terms by ceasing use of the Services and notifying us.
• b. By Company: We may terminate your access for violations of these Terms or for any other reason. Upon termination, you must cease using the Services.
• c. Survival: Sections 4, 5, 6, 7, 8, 10, 11, 12, 13, and 14 survive termination.

15. Miscellaneous

• a. Updates to Terms: We may update these Terms by posting the revised version on our website or notifying you via email or in-app notification. Continued use of the Services constitutes acceptance.
• b. Compliance with Local Laws: You must comply with all applicable laws in your jurisdiction, including consumer protection and telecommunications regulations.
• c. Export Control: You agree to comply with all applicable export control laws.

• e. Force Majeure: Neither party is liable for delays due to unforeseeable events, including cybersecurity incidents, provided they promptly resume performance.

• g. Amendments: Amendments must be in writing and signed by the Company.
• h. Severability: If any provision is invalid, the remaining provisions remain in effect.
